Why can't I view the entire list of 2007 judgments on the Decision by Number pages?

The 2007 Decision by Number webpages have been updated to list up to 500 judgments on each page instead of only 30. Therefore, the count reference within the url for the page has changed eg:

http://www.lawlink.nsw.gov.au/scjudgments/2007nswsc.nsf/WebView1?OpenView&Start=1&Count=500&ExpandView

If you have bookmarked a 2007 Decision by Number webpage that only lists 30 judgments eg:
http://www.lawlink.nsw.gov.au/scjudgments/2007nswsc.nsf/WebView1?OpenView&Start=1&Count=30&ExpandView you will need to update your bookmark. To do this you can navigate to the 2007 Decision by Number page from the Homepage.

Where can I find judgments and decisions about anti-discrimination and equal opportunity?

Decisions about anti-discrimination and equal opportunity can be found by selecting 'Administrative Decisions Tribunal' from the NSW Caselaw home page. Decisions for each year can be found by selecting the 'Equal Opportunity Division' link for the year the decision was made.

Judgments are found by searching the Supreme Court. To search for judgments and decisions in both jurisdictions select the Advanced Search option, searching for terms in the appropriate fields making sure you only choose Administrative Decisions Tribunal and Supreme Court "in any or all of these courts" check boxes.

Decisions about professional misconduct by lawyers can be found by selecting 'Administrative Decisions Tribunal' from the NSW Caselaw home page. Decisions for each year can be found by selecting the 'Legal Services Division' link for the year the decision was made.

Judgments are found by searching the Supreme Court. No, you do not need a username or password to access judgments and decisions on NSW Caselaw. The user name and password prompt appears if there is a server error or an incorrect link to the information you are trying to access. Please report these incidents via the Feedback form.

Why does the text exceed the margins?

1. The page settings in your web browser may need to be adjusted, it is recommended to set use the following settings:
    Paper: A4 210 x 297

    Margins
    • Left: 6.01 mm
    • Right: 6.18 mm
    • Top: 6.35 mm
    • Bottom: 4.74mm

Privacy

How are privacy issues dealt with when publishing judgments and decisions online?

Judgments and decisions are sometimes edited to take account of suppression orders, or if the general publication of them is likely to have an adverse impact on victims, witnesses and others connected with the proceedings. Names are replaced by initials to avoid parties being identified (eg. Applicant: Z).


How can cases or case details be removed from NSW Caselaw?

A written request should be made to the registrar of the court, identifying the material to be removed and the reason for the removal.

The request will be considered by the judicial officer who wrote the judgment or decision. If the judicial officer is no longer on the bench, then the request will be considered by the head of jurisdiction. A written response will be provided.

How does Quick Search work?

Quick Search searches all the fields present within all judgments and decisions. For instance, if you are searching for "Smith", the search will find all judgments and decisions that contain "Smith", whether "Smith" is one of the parties, the judges, or simply a reference in the judgment or decision.

To find a phrase, type in the terms surrounded by double quotation marks.

Eg. "[2005] NSWSC 20"

If you do not surround the phrase with double quotation marks the search engine will look at each word in the phrase separately providing a large number of unrelated results.

Eg. [2005] AND NSWSC AND 20

The following boolean operators can be used to optimise your search.

ANDFinds documents that contain both of the words or phrases.
Eg. criminal AND sentencing
ORFinds documents that contain any one of the entered words or phrases.
Eg. aid OR assistance
NOTFinds documents that contain the first word or phrase, but not the second.
Eg. juvenile NOT adult
W/nFinds documents where both words or phrases appear within the stated number of words.
Eg. duty W/5 care
//Finds documents where both words or phrases appear in the same paragraph.
Eg. damages // assault
*Truncation or wildcard symbol can be used to replace characters or extend the term.
Eg. child* will find child, children, child’s ect.
EXCEPTFinds documents in which the first word or phrase appears, but only if the second word or phrase is not in the same paragraph as the first.
Eg. christmas EXCEPT island
\\Finds documents where both words or phrases occur within a paragraph of each other.
Eg. interlocutory \\ evidence
. . .Finds documents where the first word or phrase is followed anywhere by the second.

How does Advanced Search work?

The Advanced Search allows you to refine your search by entering specific terms for the following fields in the judgment:

The Advanced Search will look for the field name or synonym and search for the term in the specified field or within one paragraph of the field name or synonym if it appears in the body of the judgment.

The abiliity to search by a specific court or tribunal, or all courts and tribunals is also available.

If you wish to search for a phrase in a specified field you do not need to put quotation marks around the phrase, eg. Crimes Act. The Advance Search treats the terms in each field as a phrase allowing you to search multiple fields and phrases in one search. The Advanced Search will read the terms in the example above as:

"John Smith" AND "Bergin J" AND "01/01/2006 to 31/12/2006" AND "Crimes Act" AND "murder" AND "firearm"

Why do unrelated decisions appear in the Search results?

Some results may not seem to be relevant to the criteria entered in the Advanced Search fields. The main reason is due to the way the same information is named in different jurisdictions.

For example when searching for the party names NSW Caselaw Search looks for the following terms: PARTYNAME, APPELLANT, APPLICANT, RESPONDENT, PARTIES, COMPLAINANT, INTERVENERS and searches for the party name in the Coversheet or within a paragraph of the term in the body of the judgment.
