Acting Commissioner
Land and Environment Court of NSW

$726 per day

The Honourable John Hatzistergos, MLC, Attorney General, is seeking expressions of interest from qualified persons for appointment as Acting Commissioners of the Land and Environment Court of NSW for an initial period of 12 months. Acting Commissioners are called upon from time to time to exercise the jurisdiction of the Court to determine certain of its cases, either by conciliation or hearing on the merits, as the Chief Judge may arrange.

Selection Criteria: Appointees must have tertiary qualifications and suitable knowledge of and expertise in any of the following disciplines: the law and practice of land valuation, environmental science (particularly arboriculture) or experience relating to the protection of the environment or environmental assessment, engineering (particularly environmental engineering, hydrology and civil engineering), and town planning or architecture.

Appointees must comply with, for the duration of any appointment, the pecuniary interest and conflict of interest provisions in sections 12(2B) and 14(1) of the Land and Environment Court Act 1979.

Full-time Commissioner
Land and Environment Court of NSW

$220,200 per annum plus Conveyance Allowance of $15,840 per annum

The Honourable John Hatzistergos, MLC, Attorney General, is seeking expressions of interest from qualified persons for appointment as a full-time Commissioner of the Land and Environment Court of NSW for a period of seven years. Commissioners exercise the jurisdiction of the Court to determine certain of its cases, either by conciliation or hearing on the merits.

Selection criteria: Appointees must have at least one of the qualifications detailed in section 12 of the Land and Environment Court Act 1979. These include special knowledge of and experience (and, in some cases, formal qualifications) in such fields as local government administration, town or country planning, environmental planning, environmental science, land valuation, architecture, engineering, surveying, building construction, the management of natural resources and Crown land, urban design or heritage, or being an Australian lawyer.

It is also desirable that appointees be, or be qualified to be, accredited as a mediator under the National Mediator Accreditation System or be willing to obtain such accreditation after appointment.

Community Services Division, Administrative Decisions Tribunal of NSW
Part-time Deputy President and Divisional Head
Part-time Judicial Members

The Honourable John Hatzistergos, MLC, Attorney General, is seeking expressions of interest from qualified persons for appointment as a part-time Deputy President and Divisional Head of the Community Services Division (“the CSD”) of the Administrative Decisions Tribunal of NSW (“the ADT”) for a period of up to 3 years.

Expressions of interest are also invited from qualified persons for appointment as part-time judicial members of the ADT to be assigned to the CSD for the same period.

The ADT is created by the Administrative Decisions Tribunal Act 1997. The ADT undertakes independent external review of administrative decisions made by government bodies or officials. The CSD sits as a 3 member panel made up of judicial and non-judicial members. It reviews certain decisions made in the Community Services and Ageing and Disability portfolios of government.

Membership classification and selection criteria: Deputy Presidents and non-presidential judicial members are required to be either current or former judicial officers or Australian lawyers of at least 7 years standing. Prospective appointees should be able to demonstrate their specialist expertise and experience in the work of the CSD, good communication skills, and a capacity to produce written decisions in a timely way. Experience as a tribunal member would be an advantage.
