Local Court Summons Matters
Legal aid is available for Local Court summons matters (other than domestic violence proceedings) only in the following circumstances for defendants where:
  • there is a real possibility of a gaol sentence being imposed
or
  • the matter would ordinarily have proceeded by way of a charge,
or
  • exceptional circumstances exist.
Legal aid is not available to complainants in summons matters, other than as provided in domestic violence proceedings..
A grant of aid is subject to Means Test B and the State Criminal Law Guidelines.
