Local Court Defended Summary Matters Legal aid is available for defended summary charge matters. A grant of aid is subject to Means Test B and the State Criminal Law Guidelines. Where applications for legal aid for Local Court defended matters are made within 14 days of the date set down for the hearing of the matter, aid is only available in exceptional circumstances. In Local Court defended matters legal aid is not available where the defence is frivolous, or has no possible prospects of success.
