Local Court Defended Indictable Matters
Legal aid is available for defended indictable charge matters which may be dealt with summarily. A grant of aid is subject to Means Test B and the State Criminal Law Guidelines.

Late Applications
Where applications for legal aid for Local Court defended matters are made within 14 days of the date set down for the hearing of the matter, aid is only available in exceptional circumstances.

Frivolous Defence
In Local Court defended matters legal aid is not available where the defence
    • is frivolous, or
    • has no possible prospects of success.
