Local Court Committal proceedings

Legal Aid is available for committal hearings and applications under section 48E of the Justices Act 1902. If a person granted aid is committed for trial, the grant extends to aid for that trial or sentence proceedings. These matters are subject to Means Test A and not to Means Test B.

Legal Aid granted under this pilot scheme is subject to:
  • a cap of 2 days hearing time for a single accused with an additional day of hearing time for each co-accused
  • the cap may be exceeded in exceptional circumstances with the approval of the Director Criminal Law or the Senior Solicitor Criminal Assignments
  • where reading time is allowed for the committal this will be taken into account when setting the first day fee for trial, and
  • representation is restricted to solicitor only
