Prisoners' Representation
Visiting Justice Proceedings, Parole Board Review Hearings, Life Re-sentencing Applications and Reviews of Segregation Directions

The Prisoners Legal Service provides representation for prisoners
  • at certain gaols for proceedings conducted by Visiting Justices.
  • at review hearings conducted before the Parole Board
  • for life resentencing matters in the Supreme Court
  • at review hearings of a segregation direction.

Representation in these matters is subject to Means Test B.

Representation
In these matters the Commission has determined there is no right of appeal to a Legal Aid Review Committee where aid has been refused wholly or partly on means (see s34(3)(b) of the Legal Aid Commission Act 1979

There is also no right of appeal to a Legal Aid Review Committee against a decision to provide legal aid on an inhouse basis (see ss 34(4A) and 56 (1AA) of the Legal Aid Commission Ac 1979).
