Legal Help for Flood Victims

Food victims in NSW rural and regional communities will shortly be turning to their insurers to cover their losses.

The Legal Aid Commission NSW, which recently successfully assisted the flood victims of Wollongong, is concerned to see that people affected are in an informed position to properly make their insurance claims. There are a number of steps that should be taken which include:
  • Keeping a record of flood damage including taking photos and videos where possible.
  • Asking neighbours to witness the damage.
  • Carefully checking the wording of insurance policies, and if in doubt, obtaining legal advice before speaking to claims assessors, who usually visit on site.
  • Making sure premiums have been paid in full, or are up to date, before lodging any claim. Shortfalls with premiums may affect payment.

Where claims are rejected by the insurer applications can be made cost free to the General Insurance Enquiries Complaints Service (telephone number 1300 363 683), within three months of the rejection.

The uninsured and underinsured should also seek legal advice as there may be a remedy available.
