Duty Solicitors - Who is represented?

The Duty Solicitor represents adults and children in the following matters:

Adults
  • Pleas of guilty to summary State or Commonwealth charge matters or indictable charge matters which may be dealt with summarily.
  • Bail applications.
  • Mentions and adjournments

    Children
  • Pleas of guilty to summary State or Commonwealth charge matters or indictable charge matters which may be dealt with summarily.
  • Bail applications.
  • Mentions and adjournments

    Duty does not include:
  • Defended Hearings
  • Matters requiring disbursement or other expenditure
  • Committal Hearings (both paper and defended) although duty solicitors can appear on mentions and adjournments
  • Domestic violence proceedings
  • Summons matters
  • Defended Extradition proceedings
  • Parents in Children’s Court proceedings
  • Bail applications to the District and Supreme Courts
  • Appeals to the District Court.
  • Trials and sentences in the District and Supreme Court

    Grants of legal aid for these matters require completed applications, with documented verification of income and assets, to be submitted to the Commission for determination.
