Duty Solicitor - Fee Claims

Claim for Fees Form
  • One (1) claim is to be submitted for each court date.
  • You are not required to submit applications for legal aid with your claim for fees.
  • Illegible or incomplete claims will be returned.
  • The Claim for Fees form must be fully completed:
    a) the apportionment of time section must be completed in addition to the times of arrival, departure and luncheon.
    b) number of clients and total time spent for each category of client must be noted on the Claim for Fees form. The total amount of time includes waiting, appearance and, on list days, interview time.

    Claims are assessed as follows:
  • All Local and Children's Court work is paid at a flat hourly rate which is periodically adjusted. Please refer to the scale of fees in criminal matters.
  • The rostered Duty Solicitor is paid from time of arrival at court. This can be from 8.30 am. The fee is calculated from the time of arrival at court until the time when the duty work is completed, excluding time spent on any private matters and lunch break.
  • Claims for defended hearings will not be paid
  • Co-accused rates are not paid.
  • Travel to and from Court will be paid at the current rate per km only where the return distance exceeds 70 kms and where prior approval has been obtained.
  • Any claim for disbursements will not be paid under the duty scheme. Any duty matter requiring any expenditure, including preparation time, expert reports and photocopying becomes a case matter requiring a formal grant of legal aid.
  • To facilitate efficient processing, claims must be received in this office within three months of the date of the court appearance.

    Your attention is specifically drawn to the provisions of Section 41 of the Legal Aid Commission Act, 1979 which states:

    "A private legal practitioner shall not, except with the approval of the Commission, demand or receive any payment from a legally assisted person in respect of the work assigned by the Commission to the private legal practitioner on behalf of the legally assisted person. Penalty $1000 or imprisonment for 6 months".
