Summary Criminal Prosecution - Commonwealth
Legal aid may be granted for trials in the Local Court to defend charges.
  • arising under any Commonwealth statute (including charges arising under the Corporations Law and State legislation applying to that Act)
  • where charges are to be dealt with summarily
  • there is a real prospect that the accused, if convicted would be imprisoned or would lose the capacity to to continue in his or her usual occupation
  • where charges are dealt with on indictment
  • where the applicant has a reasonable prospect of acquittal and
  • where one of the following applies
    - conviction would be likely to have a significantly detrimental effect on the defendants livelihood or employment, actual or prospective, or
    - the defendant suffers from a disabililty or disadvantage that would prevent self representation, or
    -conviction would be likely to result in a term or imprisonment (including a suspended term) being imposed.

    A grant of aid is subject to Means Test B and the Commonwealth Criminal Law Guidelines.
