Committal proceedings - Commonwealth

Legal aid may be granted for committal proceedings related to projects specifically designed to test the cost effectiveness of committal proceedings.


The Commission's pilot scheme is restricted to State criminal law matters. Commonwealth matters are excluded from this pilot scheme.

Legal aid may be granted for other committal proceedings arising under Commonwealth law where it is shown that there is a strong likelihood that representation will result in substantial benefit to the applicant so that
  • the charge which the applicant faces will be dealt with summarily
  • a committal hearing is likely to identify an early plea
  • the conduct of a committal will lead to a significant reduction in length of any significant trial, or plea, or
  • the defendant will be discharged at the committal.

    The fact that the committal may discover the prosecution case does not constitute a substantial benefit.

    A grant of aid is subject to Means Test B and the Commonwealth Criminal Law Guidelines.
