Appeals - Commonwealth

Legal aid may be granted for an applicant to appeal against conviction and/or sentence where there is a strong likelihood of quashing the conviction or of a material reduction in the sentence and
  • if successful, the appeal would result in the applicant regaining his or her liberty, livelihood or employment, or
  • the appeal involves an important question of law.

    Legal aid may be granted to respond to a Crown appeal, without regard to the merits test.

    A grant of aid is subject to Means Test A and the Commonwealth Criminal Law Guidelines.
