INDUSTRIAL RELATIONS COMMISSION OF NEW SOUTH WALES

 

Review of Award pursuant to Section 19 of the Industrial Relations Act 1996.

 

(No. IRC 1729 of 2004)

 

Before Mr Deputy President Grayson

8 June 2004

 

REVIEWED AWARD

 

1.          Delete clause 17B in the Arrangement of the award published 7 December 2001 (330 I.G. 93) and insert in lieu thereof the following:

 

17B.     Personal/Carer's Leave

 

2.          Delete subclause (d) of clause 1, Area, Incidence and Duration, and insert in lieu thereof the following:

 

(d)        The changes made to the award arising from the Award Review pursuant to section 19(6) of the Industrial Relations Act 1996 and Principle 26 of the Principles for Review of Awards made by the Industrial Relations Commission of New South Wales on 18 December 1998 (308 I.G. 307) are to take effect from 9 June 2004.

 

3.          Insert after subclause (i) of clause 12, Overtime, the following new subclause:

 

(j)         Requirements to Work Reasonable Overtime

 

(a)        Subject to subclause (b) of this clause, an employer may require an employee to work reasonable overtime at overtime rates or as otherwise provided for in this award.

 

(b)        An employee may refuse to work overtime in circumstances where the working of such overtime would result in the employee working hours which are unreasonable.

 

(c)        For the purposes of subclause (b) of this clause, what is unreasonable or otherwise will be determined having regard to:

 

(i)         any risk to employee health and safety;

 

(ii)        the employee's personal circumstances, including any family and carer responsibilities;

 

(iii)       the needs of the workplace or enterprise;

 

(iv)      the notice (if any) given by the employer of the overtime and by the employee of his or her intention to refuse it; and

 

(v)       any other relevant matter.

 

4.          Delete the title of clause 17B, State Personal Carer's Leave - August 1996, and insert in lieu thereof the following:
