AWARD
1. In clause 2,
Definitions of the award published 14 September 2012, (374 I.G. 954) for the
definition of “Higher Qualification”, delete all references to “Medical Board of
New South Wales” and replace with “Medical Council of New South Wales”.
2. In the said
clause 2, for the definition of “Police (Forensic) Medical Officer”, delete the
words “who is a person licensed or registered by the Medical Board of New South
Wales pursuant to the Medical Practice Act 1992.”, and replace with “who is a
person licensed or registered by the Australian Health Practitioner Regulation
Agency”.
3. Delete clause
7, No Further Claims and insert in lieu thereof the following:
7. No Extra Claims
Other than as provided for in the Industrial Relations
Act 1996 and the Industrial Relations (Public Sector Conditions of Employment)
Regulation 2014, there shall be no further claims/demands or proceedings
instituted before the NSW Industrial Relations Commission for extra or reduced
wages, salaries, rates of pay, allowances or conditions of employment with
respect to the Employees covered by the Award that take effect prior to 30 June
2016 by a party to this Award.
The terms of the preceding paragraph do not prevent the
parties from taking any proceedings with respect to the interpretation,
application or enforcement of existing award provisions.
4. Insert in
numerical order the following new subclause 10.4 in clause 10, Area, Incidence
and Duration:
10.4 The changes made
to the award pursuant to the Award Review pursuant to section 19(6) of the Industrial
Relations Act 1996 and Principle 26 of the Principles for Review of Awards
made by the Industrial Relations Commission of New South Wales on 28 April 1999
(310 I.G. 359) take effect on and from 27 October 2015.
This award remains in force until varied or rescinded,
the period for which it was made already having expired.
5. This variation
shall take effect on and from 27 October 2015.
