VARIATION
1. Delete
subparagraph (4) of paragraph (iii) of subclause (a) of clause 5, Rates of Pay,
of the award published 14 January 1994 (278 I.G. 1), as varied, and insert in
lieu thereof the following:
(4) The
supplementary payment at each classification level includes an amount
reflecting the application of the arbitrated safety net adjustment principle
enunciated in the State Wage Case, Matter Number IRC 2736/93. Consistent with the requirements of that
principle, the safety net adjustment as set out in Table 1 is absorbable to the
extent of any equivalent amount in rates of pay - whether overaward, award or
certified agreement - in excess of the minimum rates (classification rate and
supplementary payment) prescribed in accordance with the August 1989 National
Wage Case decision.
The relativities at each classification level relate to
supplementary payments exclusive of the supplementary payment increase arising
from the implementation of the State Wage Case, Matter No. IRC 2736/93.
The rates of pay in this award include the adjustments
payable under the State Wage Case 2001, as set out in the said Table 1 - Rates
of Pay, of Part B, Monetary Rates.
These adjustments may be offset against:
(A) any equivalent
overaward payments, and/or
(B) award wage
increases since 29 May 1991 other than safety net, State Wage Case and minimum
rates adjustments.
2. Delete Table
1 - Rates of Pay, of Part B, Monetary Rates, and insert in lieu thereof the
following:

first pay period on or after 19 July 2001.
