VARIATION
1. Delete Clause
10 State Wage Case Adjustments of the award published 23 July 2004, and
reprinted 27 January 2012 (372 I.G. 353) and insert in lieu thereof the
following:
10. State Wage Case Adjustments
and Extra Claims
10.1 The rates of
pay in this award include the adjustments payable under the State Wage Case
2012. These adjustments may be offset
against:
(a) any equivalent
overaward payments; and/or
(b) award wage
increases since 29 May 1991 other than safety net, State Wage Case, and minimum
rates adjustments.
10.2 The parties
agree that, during the period up to and including 16 December 2013, there will
be no extra wage claims, claims for improved conditions of employment or
demands made with respect to the employees covered by the award and, further,
that no proceedings, claims or demands concerning wages
or conditions of employment with respect to those employees will be instituted
before the Industrial Relations Commission or any other industrial tribunal.
The terms of the preceding paragraph do not prevent the
parties from taking any proceedings with respect to the interpretation,
application or enforcement of existing award provisions.
