VARIATION

 

1.          Delete clause 6 Overtime, of the award published 3 November 2000 (319 I.G. 1017), and insert the following:

 

6.  Overtime

 

(i)         All times worked after 38 ordinary hours in any one week or outside the span of hours as prescribed in subclauses (i) and (ii) of clause 4, Hours, or in excess of the maximum daily hours prescribed in subclause (v) of the said clause 4 shall be overtime and shall be paid at time and one half for the first two hours and double time thereafter, excepting Saturdays, when all overtime will be paid at time and one-half and on Sundays, when all overtime will be paid at double time and public holidays which will paid at double time and one half.  By agreement an employer and an employee, time off may be granted to an employee in lieu of payment for overtime rate being paid as at the rate of time off.

 

(ii)        Reasonable Overtime

 

(a)        Subject to paragraph (b) below, an employer may require an employer may require an employee to work reasonable overtime at overtime rates or as otherwise provided for in this award.

 

(b)        An employee may refuse to work overtime in circumstances where the working of such overtime would result in the employee working hours, which are reasonable.

 

(c)        For the purposes of paragraph (b) what is unreasonable or otherwise will be determined having regard to:

 

(1)        any risk to employee health and safety;

 

(2)        the employee's personal circumstances including any family and carer responsibilities;

 

(3)        the needs of the workplace or enterprise;

 

(4)        the notice (if any) given by the employer of the overtime and by the employee of his or her intention to refuse it; and

 

(5)        any other relevant matter.

 

2.          Delete subclause (iv) of clause 10, State Wage Case Adjustments, and insert in lieu thereof the following:

 

(iv)       The rates of pay in this award include the adjustments payable under the State Wage Case 2003. These adjustments may be offset against:

 

(a)        any equivalent overaward payments; and/or

 

(b)       award wage increases since 29 May 1991 other than safety net, State Wage Case, and minimum rates adjustments.

 

3.          Delete Part B, Monetary Rates, and insert in lieu thereof the following:

Note: These allowances are contemporary for expense related allowances as at 30 March 2003 and for work related allowances are inclusive of adjustment in accordance with the May 2003 State Wage Case Decision of the Industrial Relations Commission.

 

4.          This variation shall take effect from the first full pay period to commence on or after 25 July 2003.
